MINUTES

 

PLANNING BOARD MEMBERS PRESENT: Chairman, Jim Joyce; Mary Maslowski; Joseph McParland; Craig Chadwick.

PLANNING BOARD MEMBERD ABENT: Allan Peterson and David Harris
BOARD OF SELECTMEN MEMBERS PRESENT: Chair, Julie Kavanagh, Vice-Chair, Larry Ballantine; Edward McManus; Michael MacAskill; and Donald Howell.

 

OTHERS PRESENT: Town Administrator, Christopher Clark; and others.

 

CALL TO ORDER - By Chairman Joyce with a quorum present at 8:50 pm.

 

Chairman Joyce reiterated the Recording & Taping Notification that was previously announced.

 

PUBLIC MEETING

Zoning Amendment Discussion:

 

  1. Accessory Dwelling Unit Bylaw- aka Single Family Dwelling with Accessory Apartment

 

Mr. Ballantine questioned the feasibility of putting a 6 month time-frame on Accessory Apartment guidelines. He offered changing it to 3 or 4 months in order to make it feasible to house summer workers. Chairman, Joyce stated that they are open to changing the time-frame, and are looking for guidance and input.

 

Mr. Ballantine made a comment regarding the possibility that additional accessory apartments may be in conflict with CWMP. He offered at looking at regulations in neighbor towns, as well as Falmouth, who has written in additional language with regards to sewered properties. He stated that the Cape Cod Commission pointed out there is flexibility regarding the allocation of waste water flow, so that should be looked at.

 

Chairman Joyce thanked Mr. Ballantine for his suggestions, and ensured him that the Board only wants the Town to grow responsibly.

 

Ms. Maslowski pointed out that main change in this document is the addition of the matter-of-right versus the Special Permit.  In this instance, the as-of-right will make it easier for individuals to apply for an accessory apartment application.  She also pointed out that a 6 month time-frame had been suggested to the Board in order to increase work force housing, and to eliminate the likelihood of accessory apartments becoming short rentals, such as AirBnB.

 

Mr. Howell reminded everyone that the Board of Selectmen is the sewer authority, and the Board of Health only has authority over Title 5.

 

Chair Kavanagh pointed out Chatham regulations. She also acknowledged all the work the Board has done to work on these regulations.

 

Mr. McManus suggested that the criteria for by-right approval and the criteria for special permit approval should be broken into two separate sections. He also identified a typo that incorrectly referenced section 324, which does not exist.

 

Mr. MacAskill questioned why is detached apartment not by right? He suggested to look at what surrounding Towns have implemented.

 

The Planning Board will discuss the comments made at this meeting, and come before the Board of Selectmen with the final changes.

 

ADJOURNMENT: The motion was made by Chairman, Joyce to adjourn at 9:18pm. The motion was seconded by Ms. Maslowski, so voted unanimously.
